Code, Insurance § 3–302","heading":"","body":"(a) This subtitle does not apply to:\n(1) life insurance;\n(2) health insurance, except as provided in subsection (c) of this section;\n(3) annuities;\n(4) reinsurance;\n(5) wet marine and transportation insurance, except as provided in subsection (b) of this section;\n(6) insurance on a subject that is located, resident, or to be performed wholly outside the State;\n(7) insurance on vehicles or aircraft owned and principally garaged outside the State;\n(8) insurance on property or operation of railroads engaged in interstate commerce;\n(9) insurance:\n(i) on aircraft owned or operated by aircraft manufacturers or operated in scheduled interstate flight;\n(ii) on cargo of the aircraft described in item (i) of this item; or\n(iii) against liability arising out of the ownership, maintenance, or use of the aircraft described in item (i) of this item, other than workers’ compensation or employer’s liability; or\n(10) medical stop–loss insurance, as defined in § 15–129 of this article.\n(b) This subtitle applies to wet marine and transportation insurance on:\n(1) a pleasure craft under 60 feet in length that is owned and used for pleasure and not for business, hire, or other commercial use;\n(2) fishing vessels under 50 gross tons that are not part of a fleet of 3 or more vessels; and\n(3) charter or head boats under 50 gross tons that are not part of a fleet of 3 or more vessels.\n(c) Subject to § 3–306.2 of this subtitle, this subtitle applies to:\n(1) disability insurance that:\n(i) provides for lost income, revenue, or proceeds in the event that an illness, accident, or injury results in a disability that impairs an insured’s ability to work or otherwise generate income, revenue, or proceeds that the insurance is intended to replace; and\n(ii) does not include payment for medical expenses, dismemberment, or accidental death; and\n(2) short–term medical insurance that provides limited health insurance benefits for a limited period of time to:\n(i) residents of the United States who travel to another country within 30 days after the effective date of coverage; and\n(ii) residents of another country who:\n1. travel to the United States within 30 days after the effective date of coverage; and\n2. are not traveling to the United States for the purpose of attending an institution of higher education, as defined in § 10–101 of the Education Article.","path":["Article - Insurance"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gin\u0026section=3-302","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:28Z","sha256":"761809738c09e8356b1c4a6d3a27ad2907486d8a7de6cceb21d7d7a1665e63d8","source_id":"us-md","stale":false,"prev":"us-md/md.-code-insurance-3-301","next":"us-md/md.-code-insurance-3-303"},"notice":"GroundRules: Original legal text.
