Code, Insurance § 5–709","heading":"","body":"(a) On completion of a merger or consolidation, an insurer that merges or consolidates with another insurer may:\n(1) transfer to the successor insurer any deposit made by the merged or consolidated insurer under this subtitle; or\n(2) have released to the successor insurer all or part of a deposit made by the merged or consolidated insurer under this subtitle that is no longer required of the successor insurer under this article.\n(b) A transfer or release of a deposit under this section may be made only:\n(1) with the approval of the Commissioner; and\n(2) on affidavit of the officers of the merged or consolidated insurer and the successor insurer that the liabilities of the merged or consolidated insurer have been extinguished, canceled, or reinsured.","path":["Article - Insurance"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gin\u0026section=5-709","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:28Z","sha256":"49e1533409024a2653082ff34eaf6688330692ac3563af9055691e3ed75d02ac","source_id":"us-md","stale":false,"prev":"us-md/md.-code-insurance-5-708","next":"us-md/md.-code-insurance-5-801"},"notice":"GroundRules: Original legal text.
