Code, Insurance § 7–802","heading":"","body":"(a) In addition to any other penalty provided by law, a person that willfully violates this title or any regulation adopted under this title is subject to a penalty of up to $10,000 for the first day of violation and up to $1,000 for each additional day that the violation continues.\n(b) In determining the amount of any financial penalty to be imposed under this section, the Commissioner shall consider the following factors:\n(1) the seriousness of the violation;\n(2) the good faith of the violator;\n(3) the violator’s history of previous violations;\n(4) the deleterious effect of the violation on the public and the insurance industry; and\n(5) the assets of the violator.\n(c) Before imposing a penalty under this subsection, the Commissioner:\n(1) shall give the person that allegedly committed the violation notice and an opportunity for hearing; and\n(2) must find that the person willfully committed the violation.","path":["Article - Insurance"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gin\u0026section=7-802","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:28Z","sha256":"6a5856d9b5a0f8b3e2808eee58c78038d18f93df3d815f27873d573e67ea2a3b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-insurance-7-801","next":"us-md/md.-code-insurance-7-802.1"},"notice":"GroundRules: Original legal text.
