Code, Labor and Employment § 11–306","heading":"","body":"(a) If the Secretary, or the Secretary’s designee, determines that an employer has violated § 11–305 of this subtitle, the Secretary, or the Secretary’s designee:\n(1) shall issue an order compelling compliance; and\n(2) may, in the Secretary’s, or the Secretary’s designee’s, discretion, assess a civil penalty of up to $10,000 per day for each day that an employer violated § 11–305 of this subtitle.\n(b) In determining the amount of the penalty, if assessed, the Secretary, or the Secretary’s designee, shall consider:\n(1) the gravity of the violation;\n(2) the size of the employer’s business;\n(3) the employer’s good faith; and\n(4) the employer’s history of violations under this subtitle.\n(c) The assessment of a penalty under subsection (a)(2) of this section shall be subject to the notice and hearing requirements of Title 10, Subtitle 2 of the State Government Article.","path":["Article - Labor and Employment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gle\u0026section=11-306","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:38Z","sha256":"23d7a58b9e4fcf4fd6291a73e085285cf9343b1838160cb70123fb9e54d38599","source_id":"us-md","stale":false,"prev":"us-md/md.-code-labor-and-employment-11-305","next":"us-md/md.-code-labor-and-employment-11-401"},"notice":"GroundRules: Original legal text.
