Code, Labor and Employment § 3–213","heading":"","body":"(a) Except as otherwise provided in this subtitle, a minor may not be employed or allowed to work:\n(1) in, about, or in connection with the manufacturing of a hazardous substance;\n(2) in, about, or in connection with:\n(i) a blast furnace;\n(ii) a distillery where an alcoholic beverage is manufactured, bottled, wrapped, or packed;\n(iii) a railroad;\n(iv) an engineer, firefighter, or pilot on a vessel that is engaged in commerce; or\n(v) a dock or wharf other than a marina where pleasure vessels are sold or served; or\n(3) in, about, or in connection with:\n(i) the erection or repair of an electrical wire;\n(ii) the cleaning, oiling, or wiping of machinery; or\n(iii) an occupation that is prohibited by law.\n(b) Except as otherwise provided in this subtitle, a minor under the age of 16 may not be employed or allowed to work:\n(1) during the school hours set for that minor;\n(2) about or in connection with an acid, dye, gas, lye, or paint;\n(3) at, about, or in connection with:\n(i) an airport;\n(ii) a brickyard;\n(iii) a lumberyard;\n(iv) a workroom or work site where goods are manufactured or processed;\n(v) scaffolding; or\n(vi) a vessel when engaged in navigation or commerce; or\n(4) in, about, or in connection with:\n(i) construction;\n(ii) an occupation that causes dust in an injurious quantity;\n(iii) a manufacturing occupation;\n(iv) a mechanical occupation;\n(v) a processing occupation; or\n(vi) the adjustment, cleaning, or operation of power-driven machinery except:\n1. an office machine; or\n2. machinery used in a school or government institution as part of vocational training.\n(c) The Commissioner may prohibit minors being employed in an occupation if:\n(1) after a public hearing, the Commissioner determines that employment in the occupation should be prohibited to minors;\n(2) the Commissioner adopts by reference a determination by the United States Secretary of Labor under the federal Fair Labor Standards Act of 1938 that the occupation is hazardous; or\n(3) after investigation, the Commissioner determines that the occupation is injurious to:\n(i) the health or welfare of minors; or\n(ii) the morals of minors under the age of 16 years.","path":["Article - Labor and Employment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gle\u0026section=3-213","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:38Z","sha256":"bbeff6110428866e56f5f146de5ccaf9d33ffb2a9a50cbd8857ed47983f7466c","source_id":"us-md","stale":false,"prev":"us-md/md.-code-labor-and-employment-3-212","next":"us-md/md.-code-labor-and-employment-3-214"},"notice":"GroundRules: Original legal text.
