Code, Labor and Employment § 5–602","heading":"","body":"(a) (1) In this section the following words have the meanings indicated.\n(2) “Confined space” means a space that, by design:\n(i) has limited openings for entry and exit; and\n(ii) is subject to:\n1. the accumulation of a combustible agent;\n2. an accumulation of a toxic agent; or\n3. a deficiency of oxygen.\n(3) “Confined space” includes:\n(i) a basin;\n(ii) a bin;\n(iii) a degreaser;\n(iv) a duct;\n(v) a pipeline;\n(vi) a pit;\n(vii) a sewer;\n(viii) a silo;\n(ix) a tank that is enclosed or has an open top;\n(x) a tub;\n(xi) a tunnel;\n(xii) a vat;\n(xiii) a process vessel; or\n(xiv) a reaction vessel.\n(4) “Maintenance work” means cleaning, inspection, maintenance, painting, repair, servicing, or other similar work.\n(b) A person described in § 5–101(d)(2)(ii) or (iii) of this title may not allow or cause an individual described in § 5–101(c)(2)(iii) or (iv) of this title to do maintenance work in a confined space, unless the Commissioner:\n(1) grants written authorization based on a satisfactory showing that work practices in effect will protect the health and safety of the individual; or\n(2) in accordance with Subtitle 3 of this title, passes an order for a variance.\n(c) (1) This subsection applies only to an employer who is a subcontractor.\n(2) Each subcontractor who, under an original contract or subcontract, is to do maintenance work in a confined space shall give the Commissioner:\n(i) at the commencement of the maintenance work, oral notice of the maintenance work to be performed; and\n(ii) within 24 hours after the oral notice, written notice of the maintenance work.","path":["Article - Labor and Employment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gle\u0026section=5-602","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:38Z","sha256":"27695ca3b26610be31ffb1b7df19042bd7a8300dd519551b51174796410b8809","source_id":"us-md","stale":false,"prev":"us-md/md.-code-labor-and-employment-5-601","next":"us-md/md.-code-labor-and-employment-5-603"},"notice":"GroundRules: Original legal text.
