Code, Labor and Employment § 5.5–112","heading":"","body":"(a) The Commissioner shall allow variances in accordance with this section.\n(b) Any affected railroad company may apply in writing to the Commissioner for an order for a variance from any regulation or health and safety standard adopted under this title.\n(c) After a hearing, the Commissioner may grant a variance from the regulations and standards adopted under this title, if:\n(1) that action is necessary to prevent undue operational or economic hardship; or\n(2) (i) existing conditions prevent practical compliance; and\n(ii) the Commissioner determines the reasonable safety of the public and employees of the railroad company can be assured.","path":["Article - Labor and Employment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gle\u0026section=5.5-112","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:38Z","sha256":"728c8ac7c462fd393bb0138e2058d4ba81367792ebd9e30d3104952e55c90793","source_id":"us-md","stale":false,"prev":"us-md/md.-code-labor-and-employment-5.5-111","next":"us-md/md.-code-labor-and-employment-5.5-113"},"notice":"GroundRules: Original legal text.
