Code, Labor and Employment § 7–506","heading":"","body":"(a) Subject to the limitations in this section, the Commissioner may assess a civil penalty against a person who willfully or repeatedly violates:\n(1) any provision of this title;\n(2) any order passed under this title; or\n(3) any regulation adopted to carry out this title.\n(b) A civil penalty under this section may not exceed $5,000 for each violation.\n(c) (1) Before the Commissioner assesses a civil penalty against an agricultural operation, the Commissioner shall consider the appropriateness of the penalty in relation to:\n(i) the size of the business;\n(ii) any good faith effort to comply with § 7-503 of this subtitle; and\n(iii) the history of previous violations.\n(2) Before the Commissioner assesses a civil penalty against a farm labor contractor, the Commissioner shall consider the appropriateness of the penalty in relation to:\n(i) the size of the business;\n(ii) the gravity of the violation;\n(iii) the good faith of the farm labor contractor; and\n(iv) the history of previous violations in this State or in any other state that relate to licensing or to the treatment of a migrant agricultural worker.","path":["Article - Labor and Employment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gle\u0026section=7-506","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:38Z","sha256":"18f94f8ccb25a63dc3a82dc44892f0f2d8f6beaffb2bfb1ea613535d61cefa05","source_id":"us-md","stale":false,"prev":"us-md/md.-code-labor-and-employment-7-505","next":"us-md/md.-code-labor-and-employment-7-507"},"notice":"GroundRules: Original legal text.
