Code, Labor and Employment § 9–204","heading":"","body":"(a) (1) Except as provided in subsection (b) of this section, with the approval of the Commission, an individual who otherwise would not be a covered employee and the employer of the individual may elect to make the individual a covered employee by filing a joint election with the Commission.\n(2) The right to make an election under this subsection for an individual may be exercised by:\n(i) an individual who is at least 16 years old; or\n(ii) a parent or guardian of an individual who is less than 16 years old.\n(b) An individual who is not a covered employee due to § 9-223(c) of this subtitle and the employer of the individual may not make an election under this section if prohibited by federal law.","path":["Article - Labor and Employment"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=gle\u0026section=9-204","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:38Z","sha256":"64296550edb4c4c70837689851ebace533390a757943b2651a3a917e4ff5eb94","source_id":"us-md","stale":false,"prev":"us-md/md.-code-labor-and-employment-9-203","next":"us-md/md.-code-labor-and-employment-9-205"},"notice":"GroundRules: Original legal text.
