Code, Land Use § 1–206","heading":"","body":"(a) (1) In this subsection, “planning commission” includes a planning commission or board established under:\n(i) Title 2 of this article;\n(ii) Division II of this article; or\n(iii) Title 10 of the Local Government Article.\n(2) Within 6 months after appointment to a planning commission, a member shall complete an education course that includes education on:\n(i) the role of the comprehensive plan;\n(ii) if applicable, proper standards for special exceptions and variances; and\n(iii) the local jurisdiction’s local laws and regulations relating to zoning, planned development, subdivision, and other land use matters.\n(3) The failure of a member to complete an education course under this subsection may not:\n(i) invalidate a decision of the planning commission; or\n(ii) be construed to create a private cause of action by any person.\n(b) (1) In this subsection, “board of appeals” includes a board of appeals established under:\n(i) Title 4, Subtitle 3 of this article;\n(ii) § 10–403 of this article;\n(iii) Division II of this article; or\n(iv) Title 10 of the Local Government Article.\n(2) Within 6 months after appointment to a board of appeals, a member shall complete an education course that includes education on:\n(i) the role of the comprehensive plan;\n(ii) proper standards for special exceptions and variances; and\n(iii) the local jurisdiction’s local laws and regulations relating to zoning, planned development, subdivision, and other land use matters.\n(3) The failure of a member to complete an education course under this subsection may not:\n(i) invalidate a decision of the board; or\n(ii) be construed to create a private cause of action by any person.","path":["Article - Land Use"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glu\u0026section=1-206","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:47Z","sha256":"a1c7997a74349f3efc766b853d5dcf25891710c5a46e49db2f059a15fb2ec969","source_id":"us-md","stale":false,"prev":"us-md/md.-code-land-use-1-205","next":"us-md/md.-code-land-use-1-207"},"notice":"GroundRules: Original legal text.
