Code, Land Use § 16–401","heading":"","body":"(a) In this subtitle the following words have the meanings indicated.\n(b) (1) “Adversely affect” means to:\n(i) eliminate more than two employee positions assigned to perform bargaining unit work if the positions are:\n1. authorized;\n2. fully funded; and\n3. A. vacant for less than 90 days; or\nB. occupied at the time the Commission solicits a service contract; or\n(ii) permanently and involuntarily reduce:\n1. below the number of hours for regular full–time employment for more than five employees currently assigned to a regular full–time work schedule to perform bargaining unit work when the Commission solicits a service contract;\n2. the pay grade for more than five employees currently assigned to a regular full–time work schedule to perform bargaining unit work when the Commission solicits a service contract; or\n3. the base pay or fringe benefits otherwise applicable to a job classification covering more than five employees currently assigned on a full–time basis to perform bargaining unit work when the Commission solicits a service contract.\n(2) “Adversely affect” does not include an action the Commission takes in accordance with:\n(i) a bona fide disciplinary proceeding;\n(ii) an applicable collective bargaining agreement in accordance with Subtitle 2 of this title; or\n(iii) a reallocation or reassignment to another bargaining unit work or other duties that does not result in a change in job classification or grade.\n(c) “Bargaining unit work” means work duties assigned or allocated to a position occupied within the preceding 90 days by an employee who is represented by a certified representative.\n(d) “Certified representative” means an employee organization certified as an exclusive representative in accordance with Subtitle 2 of this title.\n(e) “Secretary–treasurer” means the secretary–treasurer of the Commission.\n(f) “Service contract” means a procurement contract for services that will be provided to the Commission.","path":["Article - Land Use"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glu\u0026section=16-401","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:47Z","sha256":"ac6a2bdbc1dd2738961de45f25651ecc8f595641bd3ebba6820624fcb92a2df9","source_id":"us-md","stale":false,"prev":"us-md/md.-code-land-use-16-318","next":"us-md/md.-code-land-use-16-402"},"notice":"GroundRules: Original legal text.
