Code, Land Use § 3–112","heading":"","body":"(a) The municipal growth element shall include:\n(1) the municipal corporation’s:\n(i) future municipal growth areas outside the existing corporate limits;\n(ii) past growth patterns;\n(iii) capacity of land areas available for development, redevelopment, and in–fill;\n(2) the land area needed to satisfy demand for development at densities consistent with long–term development policy;\n(3) the relationship of the long–term development policy to a vision of the municipal corporation’s future character;\n(4) rural buffers and transition areas;\n(5) protection of sensitive areas that could be impacted by development planned within the proposed municipal growth area;\n(6) population growth projections;\n(7) public services and infrastructure needed to accommodate growth within the proposed municipal growth areas, including those necessary for:\n(i) libraries;\n(ii) recreation;\n(iii) water and sewerage facilities;\n(iv) public safety, including emergency medical response;\n(v) stormwater management systems sufficient to ensure water quality both inside and outside the proposed municipal growth area; and\n(vi) public schools sufficient to accommodate student population consistent with State rated capacity standards established by the Interagency Commission on School Construction;\n(8) any burden on services and infrastructure for which the municipal corporation would be responsible for development in areas near to and outside of the proposed municipal growth area; and\n(9) anticipated financing mechanisms to support necessary public services and infrastructure.\n(b) On request of a municipal corporation, the Department of Planning shall provide technical assistance for the purposes of developing the municipal growth element of the comprehensive plan.","path":["Article - Land Use"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glu\u0026section=3-112","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:47Z","sha256":"7cb6c867a318b4f8bf733bb4cfb0a091e22f1b9943451acfa9de3f6d7b87f88e","source_id":"us-md","stale":false,"prev":"us-md/md.-code-land-use-3-111","next":"us-md/md.-code-land-use-3-113"},"notice":"GroundRules: Original legal text.
