Code, Land Use § 4–402","heading":"","body":"(a) Except as provided in subsection (b) of this section, the circuit court shall review the decision of a board of appeals or a hearing examiner under this subtitle on the record transmitted by the board of appeals or hearing examiner, and not de novo.\n(b) (1) If, after a hearing, the circuit court determines that testimony is needed for the proper disposition of the matter, the court may take evidence or appoint a special magistrate to:\n(i) take the required evidence; and\n(ii) report the evidence to the court with the special magistrate’s findings of fact and conclusions of law.\n(2) The special magistrate’s evidence, findings, and conclusions shall constitute a part of the proceedings on which the court shall make its determination.","path":["Article - Land Use"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glu\u0026section=4-402","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:47Z","sha256":"764c2fc48123c7e8c6fb2c7cde7961c51b983a2d5285968ed5bc77ae4e5c9561","source_id":"us-md","stale":false,"prev":"us-md/md.-code-land-use-4-401","next":"us-md/md.-code-land-use-4-403"},"notice":"GroundRules: Original legal text.
