Code, Land Use § 7–303","heading":"","body":"(a) A development rights and responsibilities agreement shall include:\n(1) a legal description of the real property subject to the agreement;\n(2) the names of the persons having a legal or equitable interest in the real property subject to the agreement;\n(3) the duration of the agreement;\n(4) the permissible uses of the real property;\n(5) the density or intensity of use of the real property;\n(6) the maximum height and size of structures to be located on the real property;\n(7) a description of the permits required or already approved for the development of the real property;\n(8) a statement that the proposed development is consistent with the comprehensive plan and development regulations of the local jurisdiction;\n(9) a description of the conditions, terms, restrictions, or other requirements determined by the local governing body of the local jurisdiction to be necessary to ensure the public health, safety, or welfare; and\n(10) to the extent applicable, provisions for the:\n(i) dedication of a portion of the real property for public use;\n(ii) protection of sensitive areas;\n(iii) preservation and restoration of historic structures; and\n(iv) construction or financing of public facilities.\n(b) An agreement may:\n(1) set the time frame and terms for development and construction on the real property; and\n(2) provide for other matters consistent with this division.","path":["Article - Land Use"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glu\u0026section=7-303","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:47Z","sha256":"f1c9c3ebc9cf0449df4221e462d6c4a9c953e97377d608f25e7a3fedc005a4b9","source_id":"us-md","stale":false,"prev":"us-md/md.-code-land-use-7-302","next":"us-md/md.-code-land-use-7-304"},"notice":"GroundRules: Original legal text.
