Code, Local Government § 1–1104","heading":"","body":"(a) An ordinance or resolution enacted under § 1–1102 of this subtitle shall\nprovide for:\n(1) eligibility requirements for participation in the program,\nincluding eligibility requirements for:\n(i) energy and water efficiency projects, renewable energy\ndevices, environmental remediation projects, and resiliency projects; and\n(ii) property and property owners; and\n(2) loan terms and conditions, including a provision that requires\nthat a loan be repaid over a term not to exceed the useful life of the project as\ndetermined by the program.\n(b) Eligibility requirements under subsection (a) of this section shall\ninclude a requirement that the county or municipality give due regard to the property\nowner’s ability to repay a loan provided under the program, in a manner substantially\nsimilar to that required for a mortgage loan under §§ 12–127, 12–311, 12–409.1, 12–\n925, and 12–1029 of the Commercial Law Article.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=1-1104","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"5d5f7991b095268be57ffd2219032767ebaa05dc74fcae55a02986121c2408e7","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-1-1103","next":"us-md/md.-code-local-government-1-1105"},"notice":"GroundRules: Original legal text.
