Code, Local Government § 1–1202","heading":"","body":"(a) This section applies only in:\n(1) Carroll County; and\n(2) Garrett County.\n(b) This section does not apply to:\n(1) the sale of a tobacco product from a vending machine that\ncomplies with State law;\n(2) a tobacconist establishment that engages primarily in the sale of\ntobacco products other than cigarettes, as defined in § 16–101 of the Business\nRegulation Article; or\n(3) a business that engages primarily in the retail sale of beer, wine,\nand liquor.\n(c) A person who owns or operates a business that engages in the retail sale\nof a tobacco product may not store or display a tobacco product unless the tobacco\nproduct:\n(1) is not immediately accessible to customers; and\n(2) is accessible only to the owner or operator of the business or an\nagent of the owner or operator.\n(d) A person who violates subsection (c) of this section commits a civil\ninfraction and is subject to a civil penalty of:\n(1) $100 for the first violation; and\n(2) $300 for any subsequent violation.\n(e) A citation for a second violation may not be issued within 30 days after\nthe date of the first citation.\n(f) After a citation is issued for a second violation, a citation may be issued\neach day that the violation continues after the date of the second citation.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=1-1202","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"fe697ffc07fa5ea54aacbc00ed80133c511e01fb3209afc041e588cbdf505099","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-1-1201","next":"us-md/md.-code-local-government-1-1203"},"notice":"GroundRules: Original legal text.
