Code, Local Government § 1–1302","heading":"","body":"(a) Subject to subsection (c) of this section, if a State law or regulation\nrequires a county or municipality to adopt legislation or a regulation at least as strict\nor effective as the applicable State law or regulation, the county or municipality may\nadopt the State law or regulation by reference.\n(b) If a county or municipality adopts a State law or regulation by reference,\nthe county or municipality shall specify:\n(1) whether it also adopts by reference any amendments to the State\nlaw or regulation effective after the local adoption of the State law or regulation by\nreference; and\n(2) any exceptions to the State law or regulation if the State law or\nregulation authorizes local options.\n(c) The authorization under subsection (a) of this section:\n(1) does not affect any requirement that a county or municipality\nform and maintain a local program, plan, or standard, including implementation and\nenforcement processes, required under any State law or any regulation adopted under\nthe authority of that law; and\n(2) if a State law or regulation adopted under the authority of that\nlaw authorizes local options, does not grant more authority than is granted by that\nlaw or regulation.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=1-1302","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"234b4cda402a80a67d07c66473d5d66281775755f964097b442bc14b9c0ea23c","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-1-1301","next":"us-md/md.-code-local-government-1-1303"},"notice":"GroundRules: Original legal text.
