Code, Local Government § 1–1304","heading":"","body":"(a) In this section, “civil penalty” means a civil fine or other monetary\npenalty administratively imposed.\n(b) Unless otherwise provided by statute, ordinance, or regulation, an\nofficer or unit of a county, municipality, bicounty agency, or board of license\ncommissioners authorized by law to impose a civil penalty up to a specific dollar\namount for violation of a statute, ordinance, or regulation shall consider the following\nin setting the amount of the civil penalty:\n(1) the severity of the violation;\n(2) the good faith of the violator; and\n(3) any history of prior violations.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=1-1304","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"3e8ab89b9022b2f0e42526f0d3f21180c04bad543fef789aa32640d5a578add9","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-1-1303","next":"us-md/md.-code-local-government-1-1305"},"notice":"GroundRules: Original legal text.
