Code, Local Government § 1–1308","heading":"","body":"To support, foster, or promote an affordable housing program for individuals\nor families of low or moderate income, a county or municipality may:\n(1) establish local trust funds or appropriate funds;\n(2) waive or modify building permit or development impact fees and\ncharges that are not mandated under State law for the construction or rehabilitation\nof lower income housing units:\n(i) in proportion to the number of lower income housing units\nof a development; and\n(ii) 1. that are financed, wholly or partly, by public funding\nthat requires mortgage restrictions or recorded covenants restricting the rental or\nsale of the housing units to lower income residents in accordance with specific\ngovernment program requirements; or\n2. that are developed by a nonprofit organization that:\nA. has been exempt from federal taxation under §\n501(c)(3) of the Internal Revenue Code for at least 3 years; and\nB. requires the homebuyer to participate in the\nconstruction or rehabilitation of the housing unit;\n(3) enact legislation that restricts cost and resale prices and requires\ndevelopment of affordable housing units as part of any subdivision in return for added\ndensity;\n(4) provide land or property from the inventory of the county or\nmunicipality; and\n(5) support PILOT (payment in lieu of taxes) programs to encourage\nconstruction of affordable housing.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=1-1308","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"46bf29ebbfd556c02fc981d4e0db467f6ec4e96ade122653c17207d3723a1230","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-1-1307","next":"us-md/md.-code-local-government-1-1309"},"notice":"GroundRules: Original legal text.
