Code, Local Government § 1–1309","heading":"","body":"(a) In this section, “electric company” has the meaning stated in § 1–101 of\nthe Public Utilities Article.\n(b) This section applies to all counties and municipalities.\n(c) On written request by a county or municipality, an electric company\nshall sell to the county or municipality some or all of the electric company’s existing\nstreet lighting equipment that is located in the county or municipality.\n(d) If the county or municipality purchases street lighting equipment from\nan electric company, the county or municipality shall pay to the electric company the\nfair market value of the street lighting equipment.\n(e) A county or municipality that purchases street lighting equipment in\naccordance with this section:\n(1) shall be responsible for the maintenance of the street lighting\nequipment; and\n(2) may contract with an outside entity for the maintenance of the\nstreet lighting equipment.\n(f) (1) Any person who controls the right to use space on any pole,\nlamppost, or other mounting surface previously used in the county or municipality by\nthe electric company for street lighting equipment shall allow a county or\nmunicipality that has purchased the street lighting equipment to assume the rights\nand obligations of the electric company with respect to the space for the unexpired\nterm of any lease or other agreement under which the electric company used the\nspace.\n(2) Notwithstanding paragraph (1) of this subsection, the county or\nmunicipality may not restrict or prohibit universal access for electricity or any other\nservice by assuming the rights and obligations of an electric company as to space on\nany pole, lamppost, or other mounting surface used for street lighting equipment.\n(3) Any dispute between an electric company and a county or\nmunicipality arising under this subsection shall be submitted to the Public Service\nCommission for resolution.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=1-1309","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"05d5853b66b5b6acee895fbfb474e40663aecee96fdcf060f4417cc191a74da1","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-1-1308","next":"us-md/md.-code-local-government-1-1310"},"notice":"GroundRules: Original legal text.
