Code, Local Government § 1–1318","heading":"","body":"(a) In this section, “invasive bamboo” means bamboo that is characterized\nby aggressive spreading behavior, including bamboo species in the genus\nPhyllostachys.\n(b) This section applies to all counties and municipalities.\n(c) The governing body of a county or municipality, by ordinance, may\nregulate invasive bamboo, including by prohibiting a person from:\n(1) selling invasive bamboo;\n(2) planting invasive bamboo; and\n(3) allowing invasive bamboo to grow on the property of the person\nwithout proper upkeep and appropriate containment measures, including barriers or\ntrenches.\n(d) The governing body of a county or municipality may provide for the\nenforcement of an ordinance adopted under this section by:\n(1) requiring any damages caused by invasive bamboo to be\nmitigated; and\n(2) establishing a civil fine.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=1-1318","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"913d16b3f2976882c7187cc22fd9eeeb89cd621a6aa0f1feeed97f925f28bffa","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-1-1317","next":"us-md/md.-code-local-government-1-1319"},"notice":"GroundRules: Original legal text.
