Code, Local Government § 1–1320","heading":"","body":"(a) (1) In this section the following words have the meanings indicated.\n(2) “Administration” means the Maryland Energy Administration.\n(3) “Residential energy storage system” means a system, on a\nresidential customer’s side of the meter, used to store electrical energy, or mechanical,\nchemical, or thermal energy that was once electrical energy, for use as electrical\nenergy at a later date or in a process that offsets electricity use at peak times.\n(4) “Residential solar energy system” means any configuration of\nsolar energy devices that collects and distributes solar energy for the purpose of\ngenerating electricity and that has a single residential interconnection with the\nelectrical grid.\n(5) “Solar permitting software” means:\n(i) the most recent version of a web–based platform, developed\nby the National Renewable Energy Laboratory, that provides a standard portal for\nreceiving and processing residential solar energy system and residential energy\nstorage system permit information; or\n(ii) automated software that functions to support the tracking\nand approval of residential building permits for residential solar energy systems,\nresidential energy storage systems, main electrical panel upgrades, and main\nelectrical panel devices.\n(b) This section applies to all counties and municipalities.\n(c) Subject to subsection (d) of this section and except as provided in\nsubsection (e) of this section, on or before August 1, 2025, each county and\nmunicipality shall implement solar permitting software for features supporting the\ntracking and approval of residential building permits for:\n(1) residential solar energy systems;\n(2) residential energy storage systems;\n(3) main electrical panel upgrades; and\n(4) main electrical panel derates.\n(d) A county or municipality may not be required to comply with the\nrequirements of subsection (c) of this section if:\n(1) the county or municipality does not require a permit for:\n(i) residential solar energy systems; or\n(ii) residential solar energy systems paired with a residential\nsolar energy storage system; or\n(2) as determined by the Administration, the automated software is\nno longer updated or maintained.\n(e) The Administration shall delay the initial implementation or suspend\nthe requirements of subsection (c) of this section if there are insufficient State or\nfederal funds available to the Administration to provide financial support to a county\nor municipality implementing solar permitting software as defined in subsection\n(a)(5)(i) of this section.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=1-1320","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"f966254deeab6e9d2a6a37d006f6dd4833015874194760aa1d5019ea22133cc7","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-1-1319","next":"us-md/md.-code-local-government-1-1401"},"notice":"GroundRules: Original legal text.
