Code, Local Government § 1–201","heading":"","body":"(a) This section does not apply to:\n(1) an elected official;\n(2) the head of a unit of a county or municipality who reports directly\nto:\n(i) the chief administrative officer of the county or\nmunicipality;\n(ii) an elected executive; or\n(iii) the governing body of the county or municipality; or\n(3) the chief administrative officer of the county or municipality.\n(b) (1) Except as provided in paragraph (2) of this subsection, a county\nor municipality may not require an employee to reside in the State, county, or\nmunicipality or within a specified distance of the State, county, or municipality as a\ncondition of employment.\n(2) A county or municipality may require an at–will supervisory\nemployee to reside in the State, county, or municipality or within a specified distance\nof the State, county, or municipality as a condition of employment if the at–will\nsupervisory employee reports directly to the head of a unit of the county or\nmunicipality.\n(3) Subject to subsection (c) of this section, when making\nemployment, promotion, demotion, layoff, and discharge decisions, a county or\nmunicipality may not discriminate based on an individual’s place of residence.\n(c) A county or municipality may grant a resident of the State, county, or\nmunicipality additional points or credits in employment or promotion decisions if the\npoints or credits are provided in accordance with a merit system established by the\ncounty or municipality by local law or ordinance.\n(d) An agency created under State law that provides governmental services\nto more than one county or municipality may not require an employee, as a condition\nof employment, to reside in the State or a county or municipality or within a specified\ndistance of the State, a county, or a municipality for which the agency provides\ngovernmental services.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=1-201","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"1279a895d94ba7c9c4d5a498d5892d60e5fb3cde0c8fcbdeda35f433604b3007","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-1-101","next":"us-md/md.-code-local-government-1-202"},"notice":"GroundRules: Original legal text.
