Code, Local Government § 1–206","heading":"","body":"(a) (1) Subject to paragraph (2) of this subsection, a county or\nmunicipality may:\n(i) pay the wage of an employee by direct deposit as provided\nin subsection (b) of this section; and\n(ii) require an employee to receive the payment of wages by\ndirect deposit as a condition of employment.\n(2) A county or municipality may not require the payment of wages\nby direct deposit for an employee:\n(i) who was hired before October 1, 2011, unless the county or\nmunicipality before October 1, 2011, required, by local law, regulation, or collective\nbargaining agreement, the payment of wages by direct deposit;\n(ii) whose employment is not conditioned on the employee\nreceiving the payment of wages by direct deposit; or\n(iii) 1. who does not have a personal bank account; and\n2. who informs the employee’s employer that the\nemployee wishes to opt out of direct deposit.\n(3) If a county or municipality elects to pay wages by direct deposit,\nan employee who is not required to receive the payment of wages by direct deposit\nmay elect to receive the payment of wages by direct deposit in accordance with\nsubsection (c) of this section.\n(b) If a county or municipality elects to pay the wages of its employees by\ndirect deposit, the county or municipality shall:\n(1) provide an employee who is required or elects to receive the\npayment of wages by direct deposit with an electronic fund transfer authorization\nform;\n(2) deposit the wage of an employee into a personal bank account\nselected by the employee on the electronic fund transfer authorization form; and\n(3) each time the county or municipality pays the wage of an\nemployee by direct deposit, provide the employee with a direct deposit statement that\nincludes:\n(i) the total amount of the wage;\n(ii) any amount deducted from the wage; and\n(iii) the amount of the wage directly deposited into the personal\nbank account selected by the employee.\n(c) (1) An employee who is required or elects to receive the payment of\nwages by direct deposit shall:\n(i) complete and submit to the county or municipality the\nelectronic fund transfer authorization form provided to the employee under\nsubsection (b) of this section; and\n(ii) select a personal bank account for the direct deposit of the\nemployee’s wages that is at a financial institution that participates in the automated\nclearinghouse network.\n(2) Subject to paragraph (1)(ii) of this subsection, an employee may\nchange the personal bank account or the financial institution designated on an\nelectronic fund transfer authorization form by completing and submitting to the\ncounty or municipality a new electronic fund transfer authorization form.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=1-206","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"b2b2d185dfb4776b97480b51562ec76c981bf8cb2c5110d3b94153957ecfed07","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-1-205","next":"us-md/md.-code-local-government-1-207"},"notice":"GroundRules: Original legal text.
