Code, Local Government § 1–208","heading":"","body":"(a) This section applies to all employees of a governmental unit of a county\nor a municipality in the State.\n(b) Subject to subsections (c) through (e) of this section, each governmental\nunit may provide disaster service leave with pay to employees subject to this section.\n(c) On request, an employee subject to this section may be entitled to\ndisaster service leave with pay if:\n(1) (i) the employee is certified by the American Red Cross as a\ndisaster service volunteer; and\n(ii) the American Red Cross requests the services of the\nemployee during a disaster that is designated at Level II or above in the regulations\nand procedures of the National Office of the American Red Cross; or\n(2) the employee is a member of:\n(i) the Civil Air Patrol;\n(ii) the United States Coast Guard Auxiliary;\n(iii) Maryland Voluntary Organizations Active in Disaster;\n(iv) a volunteer emergency medical services department;\n(v) a volunteer fire department;\n(vi) a volunteer rescue company or volunteer rescue squad; or\n(vii) a Community Emergency Response Team.\n(d) An employee may use up to 30 days of disaster service leave in any 12–\nmonth period only after obtaining approval from the employee’s governmental unit.\n(e) During a prolonged or recurrent disaster, the employee’s governmental\nunit may:\n(1) waive the requirements under subsections (c) and (d) of this\nsection that an employee must request and obtain approval before the employee may\nuse disaster service leave, if waiving the requirement would be in the best interest of\nthe citizens of the county or municipality; and\n(2) increase the number of days of disaster service leave under\nsubsection (d) of this section that an employee may use, if an increase in leave would\nbe in the best interest of the citizens of the county or municipality.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=1-208","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"4189fcf1772f5f9340e1bed849ab9a87b1b7d6bbf56d9b921ddf3cabc52b1e53","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-1-207","next":"us-md/md.-code-local-government-1-209"},"notice":"GroundRules: Original legal text.
