Code, Local Government § 1–402","heading":"","body":"(a) (1) In this section the following words have the meanings indicated.\n(2) “Nonresident bidder” means a bidder whose principal office is\noutside the State.\n(3) “Preference” includes:\n(i) a percentage preference;\n(ii) an employee residency requirement; or\n(iii) any other provision that favors a resident over a\nnonresident.\n(4) “Resident bidder” means a bidder whose principal office is in the\nState.\n(b) When a political subdivision or an instrumentality of government in the\nState uses competitive bidding to award a procurement contract, the political\nsubdivision or instrumentality may give a preference to the resident bidder who\nsubmits the lowest responsive bid of any resident bidder if:\n(1) the resident bidder is a responsible bidder;\n(2) a responsible nonresident bidder submits the lowest responsive\nbid of all bidders; and\n(3) the state in which the nonresident bidder’s principal office is\nlocated gives a preference to its residents.\n(c) A preference under this section shall be identical to the preference that\nthe state in which the nonresident bidder’s principal office is located gives to its\nresidents.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=1-402","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"6b10adaf727aade06e9f2ba29bf6fb23007802b2b37b09039a9cce7727c49ce3","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-1-401","next":"us-md/md.-code-local-government-1-403"},"notice":"GroundRules: Original legal text.
