Code, Local Government § 10–305","heading":"","body":"(a) A county may enact local laws to provide for:\n(1) the establishment of a county board of appeals, whose members\nshall be appointed by the county legislative body;\n(2) the number, qualifications, terms, and compensation of the\nmembers of the county board of appeals;\n(3) the adoption by the county board of appeals of rules of practice\nthat govern its proceedings; and\n(4) a decision by the county board of appeals on petition of any\ninterested person, after notice and opportunity for hearing, on the basis of a record\nbefore the board.\n(b) The county board of appeals may have original jurisdiction or\njurisdiction to review the action of an administrative officer or unit of county\ngovernment over matters arising under any law, ordinance, or regulation of the\ncounty council that concerns:\n(1) an application for a zoning variation or exception or amendment\nof a zoning map;\n(2) the issuance, renewal, denial, revocation, suspension, annulment,\nor modification of any license, permit, approval, exemption, waiver, certificate,\nregistration, or other form of permission or of any adjudicatory order;\n(3) the assessment of any special benefit tax; or\n(4) the adjudication of a violation of an ordinance delegated in\naccordance with § 4–406(b) of the Courts Article.\n(c) When issuing a decision, the county board of appeals shall file an opinion\nthat shall include a statement of the facts found and the grounds for the decision.\n(d) (1) Any person aggrieved by the decision and a party to the\nproceeding before the county board of appeals may seek review by the circuit court\nfor the county.\n(2) The circuit court may:\n(i) affirm the decision; or\n(ii) if the decision is not in accordance with law:\n1. modify the decision with or without remanding the\ncase for rehearing; or\n2. reverse the decision with or without remanding the\ncase for rehearing.\n(3) Any party to the proceeding in the circuit court aggrieved by the\ndecision of the circuit court may appeal to the Appellate Court of Maryland in the\nsame manner provided for civil cases.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=10-305","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"f9f25139b12cc31b91196422f1df67c2e4e5ecce59261e5cc0b938ed916da98e","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-10-304","next":"us-md/md.-code-local-government-10-306"},"notice":"GroundRules: Original legal text.
