Code, Local Government § 10–315","heading":"","body":"(a) In this section, “authority” means a commercial district management\nauthority.\n(b) A county may establish an authority for any commercial district in the\ncounty.\n(c) For each authority established, a county:\n(1) shall specify the membership, organization, jurisdiction, and\ngeographical limits of the authority;\n(2) shall specify the purposes of the authority, including:\n(i) promotion;\n(ii) marketing; or\n(iii) the provision of security, maintenance, or amenities in the\ndistrict;\n(3) may specify which provisions of the county charter or local law\nrelating to personnel, procurement, or similar operational matters apply to the\nauthority, except that minority business enterprise procurement and equal\nemployment opportunity laws may not be waived;\n(4) may approve the annual budget of the authority if the county\ngoverning body imposes an ad valorem tax to support the authority; and\n(5) may provide any financing that it considers appropriate for the\nauthority through fees that may be charged to, or taxes that may be imposed against,\nbusinesses subject to the authority’s jurisdiction.\n(d) An authority may not:\n(1) exercise the power of eminent domain;\n(2) purchase, sell, construct, or lease as a lessor office or retail space;\nor\n(3) except as otherwise authorized by law, engage in competition\nwith the private sector.\n(e) Any fee or tax imposed under this section shall be used only for the\npurposes stated in this section and may not revert to the general fund of the county.\n(f) A county may establish an authority in accordance with this section as\na special taxing district.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=10-315","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"82d50fe0fe1371a21d4a09ab438d1bd42837e63fcf794d89f3ae4a4b6b8ed780","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-10-314","next":"us-md/md.-code-local-government-10-316"},"notice":"GroundRules: Original legal text.
