Code, Local Government § 11–305","heading":"","body":"A juvenile curfew ordinance adopted under this subtitle does not apply to a\nminor who is:\n(1) accompanied by the minor’s parent or guardian;\n(2) performing an errand at the direction of the minor’s parent or\nguardian, without a detour or stop, until 12:30 a.m.;\n(3) accompanied by an adult authorized by the minor’s parent or\nguardian to have temporary care or custody of the minor for a designated period of\ntime within a specified area;\n(4) with consent of the minor’s parent or guardian, involved in\ninterstate travel;\n(5) engaged in legal employment activity or is going to or returning\nhome from a legal employment activity;\n(6) involved in a sudden or unexpected happening or an unforeseen\ncombination of circumstances that calls for immediate action to protect health, safety,\nwelfare, or property from actual or threatened harm or an unlawful act;\n(7) on the property where the minor resides or on the sidewalk\nabutting the minor’s residence or abutting the residence of a next–door neighbor if an\nadult resident of that property has given permission for the minor’s presence;\n(8) attending or returning directly home from:\n(i) a school, religious, or recreational activity supervised by\nadults and sponsored by the local jurisdiction, a civic organization, or a volunteer\nassociation that takes responsibility for the minor; or\n(ii) a place of public entertainment, including a movie, play, or\nsporting event;\n(9) exercising First Amendment rights under the United States\nConstitution if the minor has first submitted to the chief of the local law enforcement\nagency a written communication that:\n(i) is signed by the minor and countersigned, if practicable, by\nthe parent or guardian of the minor;\n(ii) includes the parent’s or guardian’s home address and\ntelephone number; and\n(iii) specifies when, where, and in what manner the minor will\nbe in a public place during curfew hours; or\n(10) remaining in a public place in a case of reasonable necessity if the\nminor’s parent or guardian has communicated to the chief of the local law\nenforcement agency facts:\n(i) establishing the reasonable necessity; and\n(ii) designating:\n1. the specific public place and the points of origin and\ndestination for the minor’s travel; and\n2. the times the minor will be in the public place or\ntraveling to or from the public place.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=11-305","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"4a1c20d7f2a21c439b7c774e946498b2d0b833f06bfa44ded3682d926c2606a4","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-11-304","next":"us-md/md.-code-local-government-11-306"},"notice":"GroundRules: Original legal text.
