Code, Local Government § 11–306","heading":"","body":"(a) (1) If a law enforcement officer reasonably believes that a minor is in\na public place or on the premises of an establishment in violation of a juvenile curfew\nordinance, the officer shall:\n(i) notify the minor that the minor is in violation of the\njuvenile curfew ordinance;\n(ii) require the minor to tell the officer the minor’s name,\naddress, telephone number, and where to contact the minor’s parent or guardian;\n(iii) issue the minor a written warning that the minor is in\nviolation of the juvenile curfew ordinance; and\n(iv) order the minor to promptly go home.\n(2) The law enforcement officer may take the minor:\n(i) to the minor’s home, if appropriate; or\n(ii) into custody and transport the minor to a local law\nenforcement station or designated curfew center when:\n1. the minor has received one previous written warning\nfor a violation of a juvenile curfew ordinance;\n2. the law enforcement officer has reasonable grounds\nto believe that the minor has committed a delinquent act, as defined in § 3–8A–01 of\nthe Courts Article; or\n3. taking the minor into custody is authorized under §\n3–8A–14 of the Courts Article.\n(3) A law enforcement officer may issue a civil citation for a violation\nof a juvenile curfew ordinance to:\n(i) a minor;\n(ii) a parent or guardian of a minor; or\n(iii) an owner, operator, or employee of an establishment.\n(b) The law enforcement agency shall send written notice of the violation of\nthe juvenile curfew ordinance to the minor’s parent or guardian.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=11-306","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"3a932502d877daa77407c4a8fe1fa277d70f851886e817a4530a80f1a5a28c1b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-11-305","next":"us-md/md.-code-local-government-11-307"},"notice":"GroundRules: Original legal text.
