Code, Local Government § 11–308","heading":"","body":"(a) When a minor is taken into custody for a violation of a juvenile curfew\nordinance, the law enforcement officer shall:\n(1) immediately notify the parent or guardian of the minor to come\ntake custody of the minor; and\n(2) determine whether, consistent with constitutional safeguards,\nthe minor or the parent or guardian, or both, are in violation of the juvenile curfew\nordinance.\n(b) (1) If the parent or guardian arrives to take custody of the minor and\nthe appropriate information is recorded, the minor shall be released to the custody of\nthe parent or guardian.\n(2) If the parent or guardian cannot be located or fails to take custody\nof the minor, the minor shall be released to:\n(i) the local department of social services;\n(ii) the Department of Juvenile Services; or\n(iii) another adult who will, on behalf of the parent or guardian,\nassume the responsibility of caring for the minor pending the availability or arrival\nof the parent or guardian.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=11-308","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"f330ce3dbebabddfe67e5e553d74a6490771b8f2dbc46a8a8a97dd25346415ec","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-11-307","next":"us-md/md.-code-local-government-11-401"},"notice":"GroundRules: Original legal text.
