Code, Local Government § 12–106","heading":"","body":"(a) This section applies to all counties except:\n(1) Anne Arundel County;\n(2) Baltimore City;\n(3) Baltimore County;\n(4) Cecil County;\n(5) Howard County;\n(6) Prince George’s County;\n(7) Queen Anne’s County; and\n(8) Worcester County.\n(b) The provisions of §§ 9–105 and 9–106 of this article apply to an act, an\nordinance, or a resolution adopted by a commission county under this section.\n(c) (1) Except as provided in paragraph (2) of this subsection, the\ngoverning body of a county may:\n(i) create, change, or abolish an office or a department; and\n(ii) assign additional functions to an office or a department.\n(2) The governing body of a county may not create, change, or abolish\nan office or a department or transfer a function of an office or department established\nby the Maryland Constitution, public general law, or public local law.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=12-106","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"7c1e30951f4a264ba1d99375f09d83eb3f1b6b25d58145403d52b8b2fb217be2","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-12-105","next":"us-md/md.-code-local-government-12-107"},"notice":"GroundRules: Original legal text.
