Code, Local Government § 12–202","heading":"","body":"(a) The provisions of §§ 9–105 and 9–106 of this article apply to an act, an\nordinance, or a resolution adopted under this section.\n(b) The County Commissioners of Calvert County may establish a separate\nfully funded pension plan for the Calvert County Sheriff’s department.\n(c) (1) A pension plan established under subsection (b) of this section\nmay provide for participation by:\n(i) Calvert County deputy sheriffs who are actively engaged in\nlaw enforcement;\n(ii) Calvert County correctional officers assigned to the county\ndetention center; and\n(iii) the Calvert County detention center administrator.\n(2) A pension plan established under subsection (b) of this section\nmay not be applied to an individual whose term of office ended before January 1,\n1971, if that individual is eligible to receive pension benefits under § 2–318(e) of the\nCourts Article.\n(d) A pension plan established under subsection (b) of this section shall\ninclude provisions for:\n(1) retirement age eligibility;\n(2) retirement based on years of active service, regardless of age;\n(3) early retirement eligibility;\n(4) disability retirement;\n(5) death benefits for a spouse or children;\n(6) cost–of–living adjustments; and\n(7) cash refund of contributions for participants terminating\nemployment.\n(e) An individual who participates in a pension plan established under\nsubsection (b) of this section is not eligible to receive pension benefits under § 2–\n318(e) of the Courts Article.\n(f) (1) Subject to paragraph (2) of this subsection, the County\nCommissioners of Calvert County shall determine the effective date for any pension\nplan established under subsection (b) of this section.\n(2) The effective date shall conform to the provisions of Title 31,\nSubtitle 3 of the State Personnel and Pensions Article.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=12-202","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"0d31cb040bc866efc695d302b2317c59909d0df959d0df479430ec28442b7de7","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-12-201","next":"us-md/md.-code-local-government-12-203"},"notice":"GroundRules: Original legal text.
