Code, Local Government § 12–208","heading":"","body":"(a) (1) (i) This subsection does not apply to Baltimore City.\n(ii) This subsection applies to any school teacher who is:\n1. a retiree of the Teachers’ Retirement System or the\nTeachers’ Pension System as provided for under Title 22 or Title 23 of the State\nPersonnel and Pensions Article; and\n2. receiving a retirement allowance less than $125 per\nmonth.\n(2) The county commissioners or county council may pay a retiree\ndescribed under paragraph (1)(ii) of this subsection who retired as an employee of the\ncounty public school system the lesser of:\n(i) $50 per month; or\n(ii) $125 per month less the retirement allowance the retiree\nis currently receiving.\n(3) To receive an additional monthly allowance described under\nparagraph (2) of this subsection, the retiree shall submit an application to the county\ncommissioner or county council.\n(4) Any county commissioners or county council that provides a\nmonthly allowance under paragraph (2) of this subsection annually shall impose a\ntax in an amount sufficient to pay for the additional benefit.\n(b) (1) This subsection applies to any Baltimore County school teacher\nwho is:\n(i) a retiree of the Teachers’ Retirement System or the\nTeachers’ Pension System as provided for under Title 22 or Title 23 of the State\nPersonnel and Pensions Article; and\n(ii) receiving a retirement allowance less than $125 per month.\n(2) (i) The County Council of Baltimore County may pay\nadditional benefits to an individual described under paragraph (1) of this subsection.\n(ii) The amount of the additional benefit shall be as provided\nin subsection (a)(2) of this section.\n(3) To receive an additional monthly allowance described under\nparagraph (2) of this subsection, the retiree shall submit an application to the county\ncouncil.\n(c) (1) In addition to any benefit paid in accordance with subsection (a)\nof this section, the governing body of Frederick County may pay an additional $8 per\nmonth to any retiree described in subsection (a)(1) of this section.\n(2) The governing body shall impose a tax in an amount sufficient to\npay for the additional benefit described in paragraph (1) of this subsection.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=12-208","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"b088c7fa610fac4d54e007d0ba722eb3f02f783675aaa76e1bde812e969afbae","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-12-207","next":"us-md/md.-code-local-government-12-209"},"notice":"GroundRules: Original legal text.
