Code, Local Government § 12–401","heading":"","body":"(a) This section applies to all counties, except Baltimore City.\n(b) Except as provided in §§ 12–404, 12–405, 12–406, 12–408, 12–409, 12–\n410, and 12–411 of this subtitle, the governing body of a county may:\n(1) acquire, by lease, purchase, gift, devise, bequest, condemnation,\nor any other method, an interest in any property that is needed for a public purpose;\n(2) construct buildings on the property for the benefit of the county;\n(3) sell surplus property at public sale, after advertising the sale for\nat least 20 days; or\n(4) (i) provide wholly or partly for the financing of housing or a\nhousing project; and\n(ii) place a deed of trust, mortgage, or other instrument on the\nfinanced property to ensure repayment of money used to purchase, construct,\nrehabilitate, or develop the housing or housing project.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=12-401","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"b670c52f2680cf363a91a29d8bc5cf0a291c370847d898b4efa27a745a618eb2","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-12-303","next":"us-md/md.-code-local-government-12-402"},"notice":"GroundRules: Original legal text.
