Code, Local Government § 12–407","heading":"","body":"(a) (1) The governing body of Dorchester County may:\n(i) purchase or lease personal property under a multiyear\ncontract that requires the governing body to make installment or rental payments\nduring 2 or more fiscal years;\n(ii) pay interest as part of any installment or rental payments\nin accordance with the terms of the contract; and\n(iii) pledge and assign the personal property purchased or\nleased to secure the obligation.\n(2) (i) The governing body may enter into a contract under\nparagraph (1) of this subsection only if:\n1. the governing body has appropriated money\nsufficient to pay the amount due under the contract during the first fiscal year in\nwhich the contract is effective;\n2. subject to subparagraph (ii) of this paragraph, the\ncontract authorizes the governing body to terminate the contract if money sufficient\nto pay the amount due under the contract for any fiscal year is not appropriated;\n3. the contract provides that, except if the governing\nbody defaults in payment under the contract, an obligation for payment under the\ncontract is limited to money appropriated for contract payment for that fiscal year;\nand\n4. the contract provides that, if the governing body\ndefaults in payment under the contract, the obligation for payment is limited to:\nA. money appropriated for contract payments for that\nfiscal year;\nB. any money realized from the personal property\npurchased or leased under the contract; and\nC. any other money legally available for contract\npayment.\n(ii) The contract may provide that a contract termination is\nineffective if the governing body purchases or leases personal property similar or\nfunctionally related to the property purchased or leased under the contract within a\nspecified period of time.\n(b) (1) Except as provided in subsection (d) of this section, the governing\nbody of Dorchester County may:\n(i) transfer without public sale any interest in surplus county\nreal property to another government unit in the county under terms and conditions\nand for consideration, if any, as determined by the governing body; and\n(ii) execute and acknowledge any instruments necessary to\ntransfer the property.\n(2) The governing body may:\n(i) lease surplus real property to a nonprofit organization on\nterms and conditions as determined by the governing body; and\n(ii) execute and acknowledge any instruments necessary to\nlease the property.\n(c) The governing body of Dorchester County may:\n(1) transfer without public sale surplus county real property, or any\nreversionary interest in that property, to any volunteer fire company located in the\ncounty for use in providing fire, emergency, and supporting services or facilities, on\nterms and conditions and for consideration, if any, as determined by the governing\nbody; and\n(2) execute and acknowledge any instruments necessary to transfer\nthe property.\n(d) (1) When selling or leasing riparian rights adjacent to county real\nproperty located in the City of Cambridge, the governing body of Dorchester County\nshall:\n(i) solicit sealed bids or proposals by public advertisement in\nat least one newspaper of general circulation in the county;\n(ii) open the sealed bids or proposals in public;\n(iii) reject any unresponsive or unacceptable bid or proposal;\nand\n(iv) select the bidder or offeror who proposes terms most\nfavorable to the county.\n(2) The governing body may take any action necessary to implement\na competitive bidding process under this subsection.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=12-407","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"a406961dde3f577aa3791a58ea0f69cd64a9fd042d3e9e065d80c31bd8e669da","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-12-406","next":"us-md/md.-code-local-government-12-408"},"notice":"GroundRules: Original legal text.
