Code, Local Government § 12–411","heading":"","body":"(a) (1) Notwithstanding any other provision of law, the County\nCommissioners of Somerset County may enter into a lease purchase agreement and\nrelated financing agreements to obtain property for a public purpose in the county.\n(2) The county commissioners shall solicit bids in at least two\nnewspapers of general circulation in the county before entering into a lease purchase\nagreement.\n(3) If the county commissioners enter into a multiyear lease purchase\nagreement or related financing agreement, the agreement shall be subject to\ncancellation by the county commissioners at the end of a fiscal year if sufficient money\nis not appropriated to fund the agreement in the subsequent fiscal year.\n(b) (1) The County Commissioners of Somerset County may sell any\ninterest in county surplus property by soliciting and accepting sealed bids.\n(2) The county commissioners shall publish an invitation for bids at\nleast twice in a newspaper of general circulation in the county between 10 and 90\ndays, inclusive, before the date set for opening bids.\n(3) The county commissioners:\n(i) shall open the bids in public; and\n(ii) may act on the bids only during a public session of the\ncounty commissioners.\n(4) The county commissioners may reject all bids on the property if\nthe county commissioners determine that the highest bid does not yield a reasonable\nprice.\n(5) If the county commissioners reject all bids, the county\ncommissioners:\n(i) shall record the highest bid in the minutes of the public\nsession; and\n(ii) may sell the property:\n1. by republishing an invitation for sealed bids;\n2. by public auction; or\n3. if the property is surplus school property, in\naccordance with subsection (c) of this section.\n(6) The county commissioners shall adopt an ordinance or resolution\nto govern the sale of property under this subsection.\n(c) The County Commissioners of Somerset County may sell to a\ngovernment unit located in the county surplus school board real property:\n(1) without advertising the property for sale; and\n(2) after obtaining three independent appraisals.\n(d) (1) The provisions of this subtitle do not apply to a sale of property\nunder this subsection.\n(2) The County Commissioners of Somerset County may sell the\napproximately 4.02 acres of property at county Tax Map 103, Grid 8, Parcel 1467\n(known as Whittington Elementary School) to Shore Up Inc., under terms considered\nappropriate by the county commissioners.\n(3) The county commissioners may sell the following property to the\nCity of Crisfield under terms considered appropriate by the county commissioners:\n(i) 7 North First Street, Tax Map 101, Grid 22, Parcel 757\n(.073 acres);\n(ii) 320–322 Locust Street, Tax Map 101, Grid 21, Parcel 810\n(.158 acres);\n(iii) 304 Tyler Street, Tax Map 102, Grid 11, Parcel 616 (.146\nacres); and\n(iv) 15 West Main Street, Tax Map 103, Grid 1, Parcel 1373\n(.386 acres).\n(4) The County Commissioners of Somerset County may sell the\nproperty on Revells Neck Road, county Tax Map 32, Parcel 149 under terms\nconsidered appropriate by the county commissioners.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=12-411","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"0c70fae4f7833aa190061a541351029c2610487dc306efac45b8be5b4feff91a","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-12-410","next":"us-md/md.-code-local-government-12-412"},"notice":"GroundRules: Original legal text.
