Code, Local Government § 12–529","heading":"","body":"(a) (1) The County Commissioners of Calvert County may establish road\nconstruction districts by ordinance.\n(2) Two–thirds of the property owners along a road route may\nrequest the creation of a road construction district and a road project by presenting a\nwritten petition to the county commissioners.\n(b) (1) Before establishing a road construction district, the County\nCommissioners of Calvert County shall:\n(i) hold a public hearing on the proposed district;\n(ii) send notice of the time and place of the hearing to each\nproperty owner in the proposed district by mail to the address shown on the\nassessment records; and\n(iii) publish notice of the time and place of the hearing in two\nnewspapers of general circulation in the county for 2 successive weeks.\n(2) At the hearing, the county commissioners shall:\n(i) determine the scope of the road project; and\n(ii) advise the property owners of the approximate cost and\nestimated individual benefit charges.\n(3) The county commissioners shall:\n(i) determine the feasibility of taking the road into the county\nroads system and undertaking the road project;\n(ii) determine whether on completion of the project the road\ncan be taken into the county roads system in accordance with subsection (g) of this\nsection; and\n(iii) determine whether to proceed with plans and\nspecifications for the project.\n(4) (i) If the county commissioners decide to proceed with the\nproject, the county commissioners shall set a date for a final hearing.\n(ii) The date for the final hearing may be changed only if notice\nis given in accordance with this subsection.\n(5) At the final hearing, if the county commissioners establish the\ndistrict, the county commissioners shall:\n(i) set the boundaries of the district; and\n(ii) provide for the project scope, cost estimate, and estimated\nindividual benefit charges.\n(c) (1) The estimated benefit charges on each lot or parcel of land in the\nroad construction district shall be based on the benefits accruing to the lot or parcel\nof land.\n(2) The County Commissioners of Calvert County shall determine:\n(i) when the property owners shall pay back the costs to the\ncounty;\n(ii) whether interest will be charged; and\n(iii) the rate of interest charged, if any.\n(d) If the County Commissioners of Calvert County determine to proceed\nwith the road project, they shall advertise for bids and award the contract to the\nlowest responsible bidder.\n(e) (1) On completion of a road project, the County Commissioners of\nCalvert County shall impose a benefit charge on all real property in the district.\n(2) The benefit charge shall be sufficient to meet the costs of the\nproject, including:\n(i) interest paid if a debt is created by the county\ncommissioners; and\n(ii) administrative costs, including notices to property owners\nand advertisements.\n(3) The benefit charge is a lien on the real property against which it\nis assessed and shall be paid annually in the same manner as county real property\ntaxes and for the period of time established by the county commissioners.\n(f) (1) The County Commissioners of Calvert County may purchase land\nfor use in connection with the road construction district.\n(2) The minimum right–of–way that may be purchased in accordance\nwith this section is 30 feet.\n(g) When completed to county specifications, the County Commissioners of\nCalvert County shall place the road in the county roads system.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=12-529","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"3f62fb506d3c78d32139648de54f04e7954ff6e9c304c487f5993b8815e3557a","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-12-528","next":"us-md/md.-code-local-government-12-530"},"notice":"GroundRules: Original legal text.
