Code, Local Government § 12–532","heading":"","body":"(a) Except as provided in subsection (c) of this section, Cecil County shall\nobtain the following by competitively bid contract awarded to the lowest responsive\nand responsible bidder:\n(1) the building or repair of a road; and\n(2) the purchase or lease of road or construction equipment or\nmachinery.\n(b) (1) The governing body of Cecil County shall advertise for bids on a\ncontract under subsection (a) of this section in at least one newspaper of general\ncirculation in the county.\n(2) The advertisement shall:\n(i) appear at least once;\n(ii) appear at least 1 week, but not more than 30 days, before\nthe final date for submitting bids;\n(iii) if the contract relates to building or repairing a road, set\nforth the place where the road is to be built or repaired;\n(iv) include a description of the goods or services required\nunder the contract;\n(v) state that sealed bids for goods or services will be received\nuntil the date designated in the advertisement; and\n(vi) designate a date for the opening of the bids.\n(c) (1) Subsections (a) and (b) of this section do not apply to an\nexpenditure that:\n(i) is $10,000 or less; or\n(ii) the governing body of Cecil County by a recorded majority\nvote taken at a public meeting declares to be an emergency expenditure.\n(2) For an expenditure under this subsection, the governing body\nmay determine:\n(i) the manner of providing for the expenditure; and\n(ii) if the building or repair is by contract, the manner in which\nthe contract is awarded.\n(d) (1) A contract entered into in violation of subsection (a) or (b) of this\nsection is void, unless:\n(i) a court determines in a judicial action that all parties acted\nin good faith; and\n(ii) the parties have substantially complied with the provisions\nof subsections (a) and (b) of this section.\n(2) If a contract is void under this subsection, the governing body of\nCecil County shall compensate the contractor for costs actually incurred if the\ncontractor:\n(i) acted in good faith;\n(ii) did not directly contribute to the violation; and\n(iii) did not know of the violation.\n(e) A person who willfully violates this section is guilty of a misdemeanor\nand on conviction is subject to a fine not exceeding $1,000.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=12-532","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"aec5040e486708cbdf909105aab5c0a8ad67fff97874e790704a3fe650dd05bf","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-12-531","next":"us-md/md.-code-local-government-12-533"},"notice":"GroundRules: Original legal text.
