Code, Local Government § 12–612","heading":"","body":"(a) The examiners shall:\n(1) open the bids at the time and place specified in the advertisement\nrequired under § 12–611 of this subtitle; and\n(2) award the contract for bridge building or repair to the lowest\nbidder that meets the requirements of the notice.\n(b) The person awarded the contract under subsection (a) of this section\nshall provide the governing bodies of the counties a bond issued by an approved\nsurety, in double the amount of the contract, conditioned on performance of the\ncontract.\n(c) At any time during the performance of the bridge construction or repair,\nthe examiners may inspect and direct the progress of the work.\n(d) (1) On completion of the bridge construction or repair, the examiners\nshall:\n(i) take control of the bridge and open the bridge for public\ntravel; and\n(ii) notify the governing bodies of the adjoining counties of the\ncompletion.\n(2) On notification that the bridge building or repair is complete, the\ngoverning bodies of the adjoining counties shall pay their respective portions of the\ncost of the work according to the contract.\n(e) (1) If the examiners cannot agree on the portion of the cost of building\nor repairing the bridge each of the adjoining counties should pay, each group of\nexaminers from each of the adjoining counties shall appoint an arbitrator to\ndetermine the amounts.\n(2) (i) If the arbitrators cannot agree on the portion of the cost of\nbuilding or repairing the bridge each of the adjoining counties should pay, the\narbitrators shall appoint an umpire to decide the portion of the cost each county must\npay.\n(ii) The umpire may not reside in either of the adjoining\ncounties.\n(3) The decision of the arbitrators or the umpire is final and binding\non the adjoining counties.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=12-612","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"cb2f2810dd7017899e1f28118a7ffc2ed9e90235e9da4dd555afb3dfc5a2993b","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-12-611","next":"us-md/md.-code-local-government-12-613"},"notice":"GroundRules: Original legal text.
