Code, Local Government § 12–701","heading":"","body":"(a) In this section, “Act” means the federal Watershed Protection and Flood\nPrevention Act.\n(b) The provisions of §§ 9–105 and 9–106 of this article apply to an act, an\nordinance, or a resolution adopted by a commission county under this section.\n(c) The governing body of a county may:\n(1) carry out, construct, operate, and maintain any works of\nimprovement in watershed or subwatershed areas qualifying for federal assistance\nunder the Act for:\n(i) flood prevention; or\n(ii) the conservation, development, use, and disposal of water;\n(2) satisfy the conditions for federal assistance required under the\nAct;\n(3) accept federal grants and technical assistance in accordance with\nthe Act;\n(4) (i) borrow federal money in accordance with the Act for works\nof improvement identified under item (1) of this subsection; and\n(ii) notwithstanding any public general law or public local law,\nevidence the borrowing by issuing instruments that are acceptable to the United\nStates or any of its agencies; and\n(5) borrow money from private lending institutions and evidence the\nborrowing by issuing instruments in accordance with Title 19, Subtitle 2 of this\narticle, the county charter, or local laws.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=12-701","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"3b4878a620aafac6eb771738c5d0baa75bf26d640fb770f909119b46322ebdd7","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-12-621","next":"us-md/md.-code-local-government-12-801"},"notice":"GroundRules: Original legal text.
