Code, Local Government § 13–1001","heading":"","body":"(a) This section applies only in Howard County.\n(b) (1) In this section the following words have the meanings indicated.\n(2) (i) “Disposable bag” means a plastic bag provided by a store to\na customer at the point of sale.\n(ii) “Disposable bag” does not include:\n1. a durable plastic bag with handles that is at least\n2.25 mils thick and is designed and manufactured for multiple reuse;\n2. a bag used to:\nA. package bulk items, including fruit, vegetables,\nnuts, grains, candy, or small hardware items;\nB. contain or wrap frozen foods, meat, or fish, whether\nprepackaged or not;\nC. contain or wrap flowers, potted plants, or other\ndamp items;\nD. contain unwrapped prepared foods or bakery goods;\nor\nE. contain a newspaper or dry cleaning;\n3. a bag provided by a pharmacist to contain\nprescription drugs; or\n4. plastic bags sold in packages containing multiple\nplastic bags intended for use as garbage, pet waste, or yard waste bags.\n(3) “Store” means a retail establishment that provides disposable\nbags to customers as a result of the sale of a product.\n(c) (1) The county may impose, by law, a fee on a store for the use of\ndisposable bags as a part of a retail sale of products.\n(2) The fee imposed under paragraph (1) of this subsection may not\nexceed 5 cents for each disposable bag used.\n(d) The county may only use the revenue from a fee imposed under\nsubsection (c) of this section for:\n(1) an environmental purpose, including the establishment of a\nprogram to provide reusable bags to individuals in the county; or\n(2) the implementation, administration, and enforcement of the fee.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=13-1001","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"cf9433a97d25b4f496a2fd8889d1ff408a5f7687e17cf561269228643e6d05cb","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-13-923","next":"us-md/md.-code-local-government-16-101"},"notice":"GroundRules: Original legal text.
