Code, Local Government § 13–303","heading":"","body":"(a) This part applies to a transient vendor and the principal or agent of a\ntransient vendor.\n(b) This part does not apply to:\n(1) an auctioneer or any other traveler or selling agent in the usual\ncourse of business;\n(2) the mere solicitation of orders for the future delivery of goods in\ninterstate commerce;\n(3) the sale of goods exhibited on grounds used by an agricultural\nsociety for the annual fair of that agricultural society;\n(4) a sale by any nonprofit organization or society for a charitable,\nreligious, or other public purpose;\n(5) an exhibitor that is the sole producer of the products sold at:\n(i) a convention of a religious, civic, or charitable group; or\n(ii) a nonprofit trade association, concert, cultural event, art\nand craft show, sale, exhibition, or fair;\n(6) a sale by a farmer or a farmer’s agent of produce from a truck or\nstand owned or leased by the farmer;\n(7) a show, a sale, an exhibition, or a fair conducted in the central\npedestrian area of an enclosed shopping mall; or\n(8) a sale by a seller at a residence in accordance with an invitation\nby the owner or legal occupant of the residence.\n(c) This part does not apply to a show, a sale, an exhibition, or a fair in\nWashington County:\n(1) that is conducted in the central pedestrian area of a nonenclosed\ncommercial complex that:\n(i) is located on one parcel of land; and\n(ii) contains at least 450,000 square feet of floor space and at\nleast 100 retail establishments;\n(2) that complies with all applicable codes and ordinances; and\n(3) for which all applicable permits have been obtained.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=13-303","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"66a9173d2d49a6428940aea13cbe9c29be406cf28c609049d87ab8720769fb4d","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-13-302","next":"us-md/md.-code-local-government-13-304"},"notice":"GroundRules: Original legal text.
