{"data":{"id":"us-md/md.-code-local-government-13-601","jurisdiction":"us-md","citation":"Md. Code, Local Government § 13–601","heading":"","body":"(a) Subject to subsection (b) of this section, the governing body of a county\nmay adopt an ordinance, a resolution, or a regulation or take any other action that\nthe governing body considers necessary to authorize a person to:\n(1) use the person’s property to operate a seafood business;\n(2) harvest seafood;\n(3) buy or sell seafood;\n(4) store equipment used in the person’s seafood business; and\n(5) enjoy the quiet conduct of the person’s seafood business.\n(b) (1) Before adopting an ordinance, a resolution, or a regulation under\nsubsection (a) of this section, the governing body of the county shall:\n(i) hold a public hearing on the proposed ordinance,\nresolution, or regulation;\n(ii) provide reasonable notice of the hearing; and\n(iii) obtain the written consent of the Secretary of Natural\nResources.\n(2) An ordinance, a resolution, or a regulation adopted without the\nwritten consent of the Secretary of Natural Resources is void.\n(c) In the event of a conflict, federal law, State law, or written program\nguidance issued by a unit of the federal or State government shall preempt an\nordinance, a resolution, or a regulation adopted or any other action taken under this\nsection.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=13-601","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"66b92d6a89728d8283ff7da2e228fb8e0654eec987b82916c03f91cabe7952eb","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-13-508","next":"us-md/md.-code-local-government-13-602"},"notice":"GroundRules: Original legal text.
