Code, Local Government § 20–428","heading":"","body":"(a) (1) Subject to paragraph (2) of this subsection, to protect hotel rental\ntax revenue, a county may require a hotel to file security with the county in an\namount that the county determines.\n(2) Cecil County, Talbot County, and Wicomico County may require\nsecurity under this section only for a hotel that has been in default.\n(b) Security under this section shall be:\n(1) a bond issued by a surety company that is:\n(i) authorized to do business in the State; and\n(ii) approved by the Insurance Commissioner as to solvency\nand responsibility;\n(2) cash; or\n(3) security approved by the county.\n(c) (1) If security is required under this section, the county shall give the\nhotel notice of the amount of security.\n(2) Within 5 days after a hotel receives notice that security is\nrequired, the hotel shall:\n(i) file the security; or\n(ii) submit a written request for a hearing on the security\nrequirement.\n(d) (1) If a hearing is requested under subsection (c) of this section, the\ncounty shall hold a hearing to determine the necessity, propriety, and amount of the\nsecurity.\n(2) (i) The determination at the hearing is final.\n(ii) The hotel shall comply within 15 days after the hotel\nreceives notice of the determination.\n(e) Without notice to the hotel that files security under subsection (b)(2) or\n(3) of this section, the county at any time may:\n(1) apply the cash to the hotel rental tax due; or\n(2) sell the security and apply the proceeds of the sale to the hotel\nrental tax due.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=20-428","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"28a2f9508225393fb1edce27d7dff978ad88294b7cdc824da0f0d3dab49c6dd4","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-20-427","next":"us-md/md.-code-local-government-20-431"},"notice":"GroundRules: Original legal text.
