Code, Local Government § 21–208","heading":"","body":"(a) The district council may acquire an easement in any land or structure\nthat is necessary to construct, extend, or maintain a project in the district.\n(b) (1) If the district council and property owner cannot agree on the\nacquisition of an easement in the owner’s property, the district council may begin\ncondemnation proceedings in the circuit court of the county, as provided in Title 12\nof the Real Property Article.\n(2) (i) Subject to subparagraph (ii) of this paragraph, the district\ncouncil may enter and take possession of the condemned property not less than 10\ndays after the recordation of the award in a condemnation proceeding under this\nsubsection.\n(ii) Notwithstanding an appeal or further proceedings taken\nby a defendant in the condemnation proceeding, before taking possession of the\ncondemned property, the district council shall:\n1. pay the amount of the award and all costs imposed\nto the clerk of the court; and\n2. give its corporate undertaking to abide by and fulfill\nany judgment on appeal or on further proceedings.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=21-208","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"9963a3465841960492e3fdcdae1e52c28d0833e7c078d76b9be3762b866a714d","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-21-207","next":"us-md/md.-code-local-government-21-209"},"notice":"GroundRules: Original legal text.
