Code, Local Government § 21–303","heading":"","body":"(a) The owners of 75% of the real property in a proposed district, or 75% of\nthe owners of real property in a proposed district, may present a written petition to\nthe governing body of each county where the property lies to request the creation of\na shore erosion control district.\n(b) The petition shall describe the proposed boundaries of the shore erosion\ncontrol district.\n(c) (1) On receipt of a petition, the governing body of the county shall\nrefer the petition to the Department of Natural Resources.\n(2) (i) The Department of Natural Resources shall review the\npetition and submit a report to the governing body of the county.\n(ii) The report shall contain:\n1. the Department’s recommendation concerning the\nfeasibility and need for a shore erosion control district;\n2. a description of the area to be included in the shore\nerosion control district;\n3. plans for erosion control; and\n4. estimated costs for any projects recommended for\nerosion control.\n(d) On receipt of the report, the governing body of the county may:\n(1) establish the shore erosion control district; and\n(2) designate the area to be included in the shore erosion control\ndistrict.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=21-303","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"66b7b8300774aec305f15c1d3398ab080622f869bdf742992df2f8a05ac9c425","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-21-302","next":"us-md/md.-code-local-government-21-304"},"notice":"GroundRules: Original legal text.
