Code, Local Government § 21–409","heading":"","body":"(a) For any purpose stated in § 21–410(a)(1) of this subtitle, a municipality\nmay:\n(1) establish a special taxing district;\n(2) impose ad valorem or special taxes; and\n(3) issue bonds.\n(b) (1) For any purpose stated in § 21–410(a)(2) of this subtitle, a\nmunicipality may:\n(i) establish special taxing districts;\n(ii) impose ad valorem or special taxes; and\n(iii) pledge funds under an agreement to:\n1. secure payment on MEDCO obligations;\n2. pay the costs of infrastructure improvements located\nin or supporting a transit–oriented development or a State hospital redevelopment;\nand\n3. pay the costs of operating and maintaining\ninfrastructure improvements located in or supporting a transit–oriented development\nor a State hospital redevelopment.\n(2) An agreement pledging funds as described in paragraph (1)(iii) of\nthis subsection shall:\n(i) be authorized by an ordinance or resolution of the\nmunicipality;\n(ii) be in writing;\n(iii) be executed on behalf of the municipality making the\npledge, the Maryland Economic Development Corporation, and any other person or\nentity that the governing body of the municipality determines; and\n(iv) benefit, and be enforceable on behalf of, the holders of any\nMEDCO obligation secured by the agreement.\n(c) (1) Notwithstanding any other provision of law, a municipality may\nestablish a special taxing district, issue bonds, or impose an ad valorem or special tax\nunder this part only if a request to the municipality is made by both:\n(i) the owners of at least two–thirds of the assessed valuation\nof the real property located in the special taxing district; and\n(ii) at least two–thirds of the owners of the real property\nlocated in the special taxing district.\n(2) For purposes of paragraph (1)(ii) of this subsection:\n(i) multiple owners of a single parcel are treated as a single\nowner; and\n(ii) a single owner of multiple parcels is treated as one owner.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=21-409","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"36df8e5ceff0ab445d28ea29f100e1bc82da79dde7ab6b155c62d80564f5e02d","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-21-408","next":"us-md/md.-code-local-government-21-410"},"notice":"GroundRules: Original legal text.
