Code, Local Government § 21–511","heading":"","body":"(a) Notwithstanding any other law, a county may issue bonds as provided\nunder this subtitle for the purposes stated in § 21–504(a)(1) of this subtitle.\n(b) To issue bonds under this subtitle, the governing body of a county shall\nadopt an ordinance or a resolution that:\n(1) describes the proposed undertaking;\n(2) states:\n(i) that the governing body has complied with §§ 21–506 and\n21–508 of this subtitle;\n(ii) the maximum principal amount of bonds to be issued; and\n(iii) the maximum rate of interest for the bonds; and\n(3) establishes a covenant to impose ad valorem or special taxes on\nall real and personal property in the special taxing district at a rate or in an amount\nsufficient to provide for the payment of the principal of and interest on the bonds in\neach year that the bonds are outstanding.\n(c) (1) For bonds to be issued to finance the proposed undertaking, the\nordinance or resolution may specify:\n(i) the principal amount;\n(ii) the rate of interest;\n(iii) the manner and terms of sale;\n(iv) the time of execution, issuance, and delivery;\n(v) the form, purpose, and denominations;\n(vi) the manner in which and the times and places at which the\nprincipal of and interest on the bonds shall be paid;\n(vii) conditions for payment of principal of and interest on the\nbonds before maturity; or\n(viii) other provisions consistent with this subtitle that the\ngoverning body of the county determines are necessary or desirable.\n(2) The ordinance or resolution may specify the items listed in\nparagraph (1) of this subsection or may authorize:\n(i) the county’s finance board or other appropriate financial\nofficer to specify those items by resolution; or\n(ii) the county’s chief executive officer to specify those items by\nexecutive order.\n(d) The following may not be subject to a referendum because of any State\nor local law:\n(1) an ordinance or a resolution authorizing the bonds;\n(2) an ordinance, a resolution, or an executive order passed or\nadopted in furtherance of the ordinance or resolution authorizing the bonds;\n(3) the bonds;\n(4) the designation of a special taxing district; or\n(5) the imposition of ad valorem or special taxes.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=21-511","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"770923d914ff911731aed4b8456d930c4d274e577babcd51aaeff83ab00d09a7","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-21-510","next":"us-md/md.-code-local-government-21-512"},"notice":"GroundRules: Original legal text.
