Code, Local Government § 21–622","heading":"","body":"(a) (1) In the stormwater management district, Prince George’s County\nmay require an owner or developer of a subdivision or tract of land on which buildings\nare to be erected to contribute what the county determines to be a fair share of the\ncost of a stormwater management project before the county approves or constructs\nthe project.\n(2) In the City of Bowie, the city may require an owner or developer\nof a subdivision or tract of land on which buildings are to be erected to contribute\nwhat the city determines to be a fair share of the cost of a stormwater management\nproject before the city approves or constructs the project.\n(3) In the City of Takoma Park, the city may require an owner or\ndeveloper of a subdivision or tract of land on which buildings are to be erected to\ncontribute what the City Council determines to be a fair share of the cost of a\nstormwater management project in the city’s jurisdiction before the City Council\napproves the project for construction.\n(4) In Montgomery County, except for property in the City of Takoma\nPark, the Montgomery County Council may require an owner or developer of a\nsubdivision or tract of land on which buildings are to be erected to contribute what\nthe County Council determines to be a fair share of the cost of a stormwater\nmanagement project in the county’s jurisdiction before the County Council approves\nthe project for construction.\n(5) Before construction begins, the contribution shall be paid in cash\nor secured to the satisfaction of the approving authority.\n(b) Montgomery County, Prince George’s County, the City of Bowie, and the\nCity of Takoma Park each may construct in its boundaries any part of an approved\nstormwater management project if the owner or developer contributes a share of the\ncost of the project considered appropriate by the approving authority.\n(c) Montgomery County, Prince George’s County, the City of Bowie, and the\nCity of Takoma Park each shall include in its annual capital budget for stormwater\nmanagement capital projects an amount representing anticipated contributions to\nstormwater management.","path":["Article - Local Government"],"source_url":"https://mgaleg.maryland.gov/mgawebsite/Laws/StatuteText?article=glg\u0026section=21-622","current_through":"2026-01-01","vintage":"","retrieved_at":"2026-09-14T19:59:58Z","sha256":"d4d8a3c02711c8ba1be684ec0ffe55cbb6cd50d59eb34f15a3a0fc796371adc1","source_id":"us-md","stale":false,"prev":"us-md/md.-code-local-government-21-621","next":"us-md/md.-code-local-government-21-623"},"notice":"GroundRules: Original legal text.
